These Terms and Conditions apply to all online orders for the supply of takeaway products ("Products") by Mango Aber Limited t/a Shilam (“Shilam”) to you, the Customer from our website http://www.shilam.co.uk/ (including the mobile optimised version of our website accessible from your hand held portable device) (the "Website").

You must be 18 or over to place an order on our Website.

All orders for Products shall be deemed to be an offer by the Customer in accordance with these Terms and Conditions, which if accepted by us will create a binding contract. Your card or account will be debited with the value of your Products when you click the "confirm" button, these sums will be refunded to you if Shilam notifies you that we are unable to accept your order.

Acceptance of the order shall be at Shilams' discretion and shall occur when you receive an on-screen message and/or e-mail confirming your order has been placed and providing you with a unique order number. We reserve the right to refuse your offer for any reason should we consider it necessary.

Products may be ordered for collection in a particular time slot. Restaurants can only accept a limited number of orders in each 15 minute slot and Shilam reserves the right to not accept an order if this limit is reached.

We are unable to accept orders less than 15 minutes before the stated closing time of our restaurant.

Please check your order carefully before you click "confirm" as Shilam is not responsible for user-errors including choosing the wrong restaurant, collection time/date, quantities or Products.

All prices stated on the Website are inclusive of VAT and any other applicable taxes. The price of any Product may vary from time to time.

Sometimes Products listed on our Website may be incorrectly priced due to technical or human error. If Shilam becomes aware of an error we will verify the price with you prior to accepting your order and you will have the opportunity to decide whether or not you wish to proceed with your order.

When placing an order either by our Website you can pay by American Express, debit card or credit card only. If you wish to pay by any other method you will need to visit the restaurant to place your order.

Subject to any special offers, the minimum value for online orders is £6.00 and the maximum value is £200.00. If your order is below or in excess of these limits you will not be permitted to checkout. All orders of a value above £100 must be placed directly with our restaurant, either by telephone or in person.

By providing us with payment details you promise that you are authorised to use the account details submitted by you. You promise to indemnify us for any claims, losses or damages incurred by us or our affiliates or business partners as a result of any unauthorised or fraudulent use by you of a credit or debit card account.

Your choice of payment method is subject to the terms and conditions of your card or account provider. If for any reason we are unable to obtain any payment due to us by you from your card or account provider, you agree to immediately pay such amount to us using other means.

Shilam reserve the right to terminate this agreement with you if Shilam are refused authority for payment or reasonably believe that payment will be refused at any stage.

From time to time we make offers available to our customers. Any special offers are subject to the terms and conditions of those offers which will include details of whether they are available for online ordering.

Great care is taken in the preparation of all our Products, however, our restaurants are busy working environments and there is a risk that Products without a particular ingredient may still contain traces of that ingredient. If you have an allergy we recommend that you telephone our restaurant to inform them of your requirements directly. Please note that some Products may contain traces of bone.

Once you click "confirm", your order is final and cannot be amended by you.

All Product orders are subject to availability. If a Product you have requested is not available, the restaurant will use reasonable endeavours to provide as close an alternative as possible and will advise you by telephone, text message and/or email of this change. If you do not want to accept the alternative, your order will be cancelled and you may either re-order an alternative Product or receive a full refund in relation to the amended Product if your payment has already been taken.

If you wish to cancel your order after you have placed it, you will need to contact the restaurant you ordered from directly. If the order has not been processed, you will not be charged. However, if the order has already been processed by the restaurant, cancellation of the order, and any refund, will be entirely at the restaurant's discretion.

In the event that you are unable to collect your order and have not contacted the restaurant prior to your collection time to request a cancellation, a refund will not be permitted, apart from in exceptional circumstances where any refund will be at the restaurant's discretion.

Shilam reserves the right to cancel an order in circumstances where we are unable to fulfil your order for reasons outside our control. We will notify you immediately if this is the case and you will receive a full refund in relation to the Product if your payment has already been taken.

When issuing a refund, we will endeavour to refund the monies to the card or account used to pay for the order within 3 to 10 working days.

For the purposes of making an order, you will need to provide an email address and telephone or mobile number. Please ensure that the contact details that you provide are correct as incorrect personal details may lead to problems or delays in processing your order.

We will hold all your personal information in accordance with our Privacy and Cookies Policy.

To the fullest extent permitted by law, and save in respect of death or personal injury caused by our negligence, Shilam excludes all liability arising out of its supply of the Products or your use of our Website.

Nothing in these conditions shall affect your statutory rights.

Products purchased from Shilam are not designed, packaged or prepared for the purposes of resale or any other commercial use.

Shilam products are sold on a direct consumer basis, where the person who places the online order, collects their order in person for the purposes of their own private consumption.

Shilam cannot be held responsible for the content or quality of products ordered via any third party agency, or via any party that is not the end customer, that places an order on behalf of someone else, or handles our products once they have left our restaurant premises, e.g. for the purposes of a delivery service.

Shilam has the right to revise and amend these terms and conditions from time to time. The revised terms and conditions will be available via our website. You should check these terms and conditions regularly to ensure that you are happy with any changes. You will be deemed to have accepted any changes to the terms and conditions at the time of placing an order.

These Terms are personal to you and Shilam and may not be enforced by any third party, whether pursuant to the Contracts (rights of Third Parties) Act 1999 or otherwise.

Any contract to which these Terms and Conditions apply shall be governed by and construed in accordance with English law and you and we agree to submit to the Courts of England to deal with any dispute arising out of or in connection with this Agreement.
